Read this first. If you only want to install or use PegaProx on your own infrastructure, you can ignore this page — the AGPL-3.0 licence shipped with the software is what governs that. These Terms apply to this website (and our other public websites, listed below).

01 Scope & agreement

These Terms of Use ("Terms") apply to your use of the following public websites operated by us (each a "Site", together the "Sites"):

  • pegaprox.com — project marketing and information
  • docs.pegaprox.com — public documentation
  • updates.pegaprox.com — the software update mirror used by deployed PegaProx instances

By accessing any Site you confirm that you have read and accept these Terms. If you do not accept them, please leave the Site.

These Terms do not apply to: (a) the PegaProx software itself, which is governed by its own AGPL-3.0 licence (see § 3); (b) third-party services we link to (Open Collective, GitHub, etc.), which are governed by their own terms.

Privacy is covered separately in our Privacy Notice. Operator and contact details are in the Legal Notice.

02 Who operates these websites

The Sites are operated by Nico Schmidt as a natural-person operator of the PegaProx open-source project, with a UK correspondence address (see the Legal Notice for full details). PegaProx is fiscally hosted by Open Source Collective, a U.S. 501(c)(6) non-profit, for donation handling — but the Sites themselves are operated by us, not by Open Source Collective.

03 The PegaProx software is AGPL-3.0

The PegaProx software is published under the GNU Affero General Public License, version 3 (AGPL-3.0). Your rights and obligations when you install, modify, redistribute or run PegaProx on your own infrastructure are governed by that licence, not by these Terms. Where these Terms and the AGPL-3.0 conflict in respect of the software, the AGPL-3.0 controls.

Nothing in these Terms grants you any additional licence to the software, and nothing here removes any rights the AGPL-3.0 grants you.

You can find the licence text in the LICENSE file of every release tarball and in the project repository at github.com/PegaProx/project-pegaprox.

04 Acceptable use of the websites

You may use the Sites for lawful purposes — to evaluate, learn about, install or update PegaProx, to read documentation, or to support the project. You must:

  • Comply with all applicable laws (including UK and any local laws that apply to you).
  • Respect rate limits and refrain from automated traffic that could interfere with normal use of the Sites.
  • Not impersonate us, the PegaProx project, our sponsors, or any other person.
  • Not interfere with security features, attempt to gain unauthorised access to systems or accounts, or probe for vulnerabilities outside of a coordinated security-research process (see § 5).

05 Prohibited activities

You must not:

  • Disrupt the Sites — denial-of-service, traffic flooding, deliberately abusive crawling, or any other activity intended or likely to degrade the service for others.
  • Bypass or attack security controls — including authentication, rate limits, WAF rules, or update-mirror integrity checks.
  • Use the update mirror as a generic CDN — see § 6.
  • Scrape at scale — wholesale automated copying of the Sites (e.g., to train ML models on docs content) without our prior written consent. This does not affect the rights granted by AGPL-3.0 in respect of the source code itself, which is hosted on GitHub.
  • Reverse-engineer or repurpose the Sites in a way that suggests endorsement, partnership, or affiliation that does not exist.
  • Conduct unauthorised security testing against our infrastructure. If you have found a vulnerability, please report it responsibly to support@pegaprox.com with subject "Security report" — we will acknowledge promptly and won't take legal action against good-faith research that follows coordinated disclosure norms (no service degradation, no access to data that isn't yours).
  • Use the Sites to host or distribute unlawful content, malware, phishing material, or anything that infringes others' rights.

06 The update mirror — fair use

updates.pegaprox.com exists so that deployed PegaProx instances can check for and download new releases. You may use it for that purpose. We ask that you don't:

  • Poll more often than necessary (the default check cadence built into PegaProx is fine; please don't shorten it artificially).
  • Treat it as a generic file-distribution CDN for unrelated content.
  • Mirror the entire archive store onto third-party infrastructure without telling us — happy to discuss it (support@pegaprox.com) if you have a legitimate reason (e.g., you run an air-gapped fleet and want a local mirror).

We may rate-limit or block IPs that abuse the mirror. We do not guarantee continuous availability of the mirror; if it is unavailable, releases remain available on GitHub.

07 Trademarks & brand assets

"PegaProx" and the PegaProx pegasus mark are unregistered trademarks of the project — protected in the United Kingdom under the common-law tort of passing off, and under analogous unregistered-mark doctrines in other jurisdictions where applicable. We make our brand assets available for download on the homepage media-kit so you can write about, integrate with, or recommend PegaProx — see pegaprox.com/#press for downloadable variants.

You may use the PegaProx name and pegasus mark to refer to the project (e.g., in a blog post, a video, an integration listing, a comparison table) provided you:

  • Don't recolour, distort, animate or visually alter the marks beyond reasonable scaling.
  • Don't suggest that you are part of, endorsed by, or in partnership with the PegaProx project unless you actually are.
  • Don't use the marks for products, domain names, app-store listings or merchandise that could cause confusion as to origin without our prior written consent.

Third-party marks mentioned on the Sites — including Proxmox®, VMware®, ESXi®, vCenter®, XCP-ng®, NetApp®, ONTAP®, SnapMirror®, Slack®, Linux®, and others — are the property of their respective owners and are referred to here for descriptive and interoperability purposes only. No endorsement, affiliation or partnership is implied.

09 Donations & fiscal sponsor

Donations to the PegaProx project are processed by Open Collective Inc. on behalf of our fiscal sponsor, Open Source Collective (a U.S. 501(c)(6) non-profit). Donations are governed by Open Collective's own terms (opencollective.com/tos) and Open Source Collective's policies. We do not directly process or store payment information for donations.

Donations are voluntary contributions and are not refundable except where required by law or by Open Collective's refund policy. Donations do not entitle the donor to any product, service, support obligation, feature delivery or commercial benefit. Specifically, sponsorship listings on the Sites are an acknowledgement, not a contract.

Sponsorship arrangements (logo placement on the Sites or in the software at sponsor tiers) are documented case-by-case and reflect the sponsor's actual support of the project at the time of listing. We may add, modify or remove sponsor listings to reflect current arrangements.

10 Third-party services & outbound links

The Sites load resources from and link out to third-party services (Cloudflare CDN, Google Fonts, GitHub, YouTube, Open Collective, sponsor websites, contributor profiles, and others). We are not responsible for the content, availability, security, terms or privacy practices of those services. Following an outbound link is at your own discretion and risk.

11 Disclaimer of warranties

The Sites are provided "as is" and "as available". To the fullest extent permitted by law:

  • We make no warranties or representations about the accuracy, completeness, timeliness or reliability of any content on the Sites.
  • We do not warrant that the Sites will be uninterrupted, secure, error-free or free of harmful components.
  • Documentation is offered for general information; it is not professional advice and should not be relied on as the sole basis for production-impacting decisions.

Nothing in this section limits any warranty or other right that cannot be excluded under applicable law (including, where you are a consumer in the UK or EEA, your statutory consumer rights).

12 Limitation of liability

To the fullest extent permitted by law, neither the PegaProx project, the operator named in § 2, our fiscal sponsor, our sponsors, our contributors, nor any of our agents will be liable to you for:

  • Any indirect, incidental, consequential, special, exemplary or punitive damages.
  • Loss of profits, revenue, data, goodwill, business opportunities, or anticipated savings.
  • Damages arising from your use of, or inability to use, the Sites or any content on them.
  • Damages arising from third-party services we link to or from third-party content displayed on the Sites.

Where liability cannot be excluded by law, our aggregate liability to you for any claim arising in connection with the Sites is limited to £100 or the amount you have donated to the PegaProx project in the 12 months preceding the claim, whichever is greater.

Nothing in these Terms excludes or limits our liability for:

  • Death or personal injury caused by our negligence.
  • Fraud or fraudulent misrepresentation.
  • Any liability that cannot be excluded under the Consumer Rights Act 2015, the Unfair Contract Terms Act 1977, or any other applicable mandatory law.

The PegaProx software itself, when run on your infrastructure, comes with no warranty under the AGPL-3.0 — see § 15-17 of that licence.

13 Indemnity

You agree to indemnify and hold us, our contributors, our fiscal sponsor and our sponsors harmless from any claims, damages, costs and expenses (including reasonable legal fees) arising out of:

  • Your breach of these Terms.
  • Your misuse of the Sites — including activity prohibited under § 5.
  • Your violation of any applicable law or third-party right in connection with your use of the Sites.

This obligation does not apply where the claim arises from our negligence, our breach of these Terms, or any other matter for which liability cannot be transferred to you under applicable law.

14 Suspension of access

Because the Sites have no user accounts, we have no contractual relationship to terminate. We may, however, restrict or block your access — typically by IP, user-agent, or network range — if your activity falls within § 5 (prohibited activities), is materially abusive, or threatens the integrity or availability of the Sites for other users. We may do so without prior notice where necessary to protect the service.

If you believe access has been blocked unfairly, please contact us at support@pegaprox.com; we will review in good faith.

15 Changes to these Terms

We may update these Terms from time to time — for example, when we add new functionality to the Sites, change service providers, or in response to changes in applicable law. The version number and "last updated" date at the top of this page reflect the current revision. Material changes will be announced with reasonable prominence (a homepage notice or a banner on the affected page) before they take effect; continued use of the Sites after the new version is published constitutes acceptance.

16 Governing law & jurisdiction

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes) are governed by the laws of England & Wales. Subject to the paragraph below, the courts of England & Wales have exclusive jurisdiction to settle any such dispute or claim.

If you are a consumer resident in the European Union, the United Kingdom or another jurisdiction whose mandatory consumer-protection rules apply to you, nothing in this section deprives you of the protection of those rules or of your right to bring proceedings in the courts of your country of residence as that local law permits.

EU consumers may also use the European Commission's Online Dispute Resolution platform: ec.europa.eu/consumers/odr. We are, however, not obliged and do not commit to participate in alternative dispute resolution proceedings before a consumer arbitration board.

17 Severability & entire agreement

If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it valid and enforceable, or — if that is not possible — severed from these Terms; the remaining provisions will continue in full force and effect.

Together with the Privacy Notice and the Legal Notice, these Terms constitute the entire agreement between you and us regarding your use of the Sites and supersede any prior version of the Terms (including the previous "Terms of Service" published before this version).

Our failure to enforce any provision is not a waiver of that provision. You may not assign or transfer your rights or obligations under these Terms. We may assign these Terms to a successor entity that takes over operation of the project (for example, if the project is incorporated into a non-profit foundation in the future); we will publish a notice if that happens.
